General Terms and Conditions of Sale

The following sales terms and conditions are established between Laguiole Export SASU, with a capital of €500, headquartered at 1b rue mornay, 75004 Paris, registered in the Paris Trade and Companies Register under number Paris B 832 161 392, hereinafter referred to as “Laguiole Export – Lavolé Gwenael”, and manages the website laguiole.jp, and any individual or legal entity wishing to make a purchase via this website, hereinafter referred to as the “buyer”.

Article 1. Purpose

These terms and conditions aim to define the contractual relationship between Laguiole Export and the buyer, as well as the conditions applicable to any purchase made through the website [https://laguiole.jp/](https://laguiole.jp/). Buying a product through this site implies the buyer’s unreserved acceptance of these sales terms, of which the buyer acknowledges having read before placing the order. Before any transaction, the buyer declares that their purchase on the website is not directly related to their professional activity and is limited to strictly personal use. Moreover, the buyer acknowledges they possess full legal capacity, allowing them to commit to these general sales conditions.

Laguiole Export reserves the right to modify these sales conditions at any time, to comply with new regulations or to improve the site’s user experience. Hence, the applicable conditions will be those in effect on the date of the buyer’s order.

Article 2. Products

The products offered are those listed on the [https://laguiole.jp/] website, subject to stock availability. Laguiole Export reserves the right to modify its product range at any time. Each product is presented with a description detailing its main technical features. The photographs are as accurate as possible but do not bind the Seller given the materials’ origin and the products’ handcrafted nature. The sale of products is intended for buyers residing in countries that fully allow these products’ entry.

Article 3. Pricing

Prices listed on the website’s product pages are in Euros (€) and are inclusive of all taxes (TTC), considering the VAT rate on the order date. Any change in the VAT rate may be reflected in product prices. Laguiole Export reserves the right to change its prices at any time. However, the price listed on the catalog on the order date will be the only one applicable to the buyer. Prices do not include shipping costs, billed in addition to the purchased products based on the total order amount. In mainland France, a shipping fee will be charged at €9 for Colissimo or €17 for DHL. No profit is made on delivery. Laguiole Export reserves the right to adjust these prices based on carriers’ rate changes.

Article 4. Order and Payment Methods

Due to data privacy policies, account creation is now obsolete. Delivery tracking is managed via email and notifications from the selected carrier. We disengage from managing data by these delivery companies. By accepting delivery from a carrier, you fully agree to use your postal address, email, and phone number for optimal delivery conditions. If your package is not received or is stolen from your mailbox or during delivery, we are not responsible. If your package is marked as delivered but not received, you have 48 hours to file a claim with our customer service to dispute this with the carrier.

– Secure payment via Paypal or credit card (through the Paypal system): The buyer selects products they wish to order in the “basket”, makes any necessary adjustments (quantities, references, etc.), checks or inputs their delivery address. Shipping costs are then calculated and shown to the buyer, as well as the carrier’s name. Next, the buyer selects their payment method: “Paypal Payment”. They are then asked to review all information, read and accept the general sales conditions by ticking the corresponding box, and finalize the order by clicking “Confirm my order”. Finally, the buyer is directed to the secure PAYPAL interface to safely input their Paypal account or credit card details. If the payment is accepted, the order is registered, and the contract is finalized. Paypal or credit card payment is irrevocable. In case of fraudulent use, the buyer can demand a payment cancellation, and the sums paid will be credited back or refunded. A credit card holder is not liable if the contested payment was proven to be made fraudulently, remotely, without physically using their card. To get a fraudulent charge refund and any bank charges that may have resulted, the cardholder must dispute the charge in writing to their bank within 70 days of the transaction, or 120 days if their agreement allows. Amounts charged are refunded by the bank within a maximum of one month after receiving the written dispute. No refund fees will be charged to the cardholder.

Confirming an order implies acceptance of these terms, acknowledging full understanding, and waiving the right to use one’s purchasing conditions. All provided data and the confirmed order will act as proof of the transaction. Article 5. Retention of Title

Laguiole Export retains full and complete ownership of the products sold until the full payment of the price, including principal, fees, and taxes.

Article 6. Withdrawal

The buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for the return shipping costs.

(1) Under Article L121-20 of the Consumer Code, you have 14 days from the date of receipt to exercise your right of withdrawal. Please note that the payment institution’s transaction fees will be deducted from your purchase amount (3.5% + 0.25€) as well as handling costs: box/envelope/shipping costs if these were free at the time of your order. We do not refund the return shipping costs of these products. We accept changes of mind but cannot operate at a loss. Therefore, we ask you to make your product choice carefully when purchasing.

(2) Engraving is offered on our products. Any personalized product cannot be exchanged or refunded. Any spelling mistakes made by you cannot be exchanged or refunded.

(3) The handle materials are of natural origin. They cannot be claimed for non-conformity to photos. By accepting these general sales conditions, you implicitly agree with the note on each product page: “Please note that the photo is representative, but does not guarantee you will get this exact color/grain due to the 100% natural origin of the handle material. However, it will closely resemble one of these photos.”

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are carried out by La Poste via COLISSIMO, or DHL, a delivery service with tracking and signature upon receipt. Laguiole Export can provide the buyer with the package’s tracking number by email. The buyer is delivered at home by their mail carrier. If the buyer is absent, they will receive a notice from their mail carrier, allowing them to pick up the ordered products from the nearest Post Office within a period indicated by the postal services. The risks associated with transport are borne by the purchaser from the moment the articles leave the premises of Laguiole Export. The buyer must check the packaging and content condition upon delivery in the presence of the Post Office employee or the delivery person. In case of damage during transport, any complaints must be made to the carrier within three days of delivery.

Article 7Bis – Customs Duties and Import Taxes

For orders shipped outside of the European Union, customs duties, import taxes, and any other associated fees may be imposed by the recipient’s local government or customs authority. These fees are not included in the prices displayed on our website, nor are they covered or reimbursed by Laguiole Export. It is the responsibility of the recipient to be aware of and cover any import duties, taxes, and charges that may be incurred. By placing an order on https://laguiole.jp/, you acknowledge and agree to be solely responsible for any customs duties or import taxes imposed by your respective country. We recommend consulting your local customs office for further information on import regulations and tariffs in your country before placing an order.

Article 8. Liability

In the distance selling process, Laguiole Export is only bound by a best-efforts obligation. Its responsibility cannot be engaged for damages resulting from the use of the Internet network such as data loss, intrusion, virus, service breakdown, or other unintentional problems.

Article 9. Intellectual Property

All elements of the website https://laguiole.jp/ are and remain the exclusive intellectual property of Laguiole Export. No one is authorized to reproduce, exploit, or use any elements of the website, whether they are in the form of a photo, logo, visual, or text.

Article 10. Personal Data

Laguiole Export commits to preserving the confidentiality of the information provided by the buyer, which they would transmit for the use of certain services. Any information about him is subject to the provisions of the law n° 78-17 of January 6, 1978. Therefore, the user has the right to access, modify, and delete information about him. Article 11. Warranty

(1) Legal warranty rights apply. Laguiole en Aubrac offers a lifetime warranty against any manufacturing defects. Usage defects are not covered by the warranty. Laguiole en Aubrac products not purchased on this site cannot be covered. Only clients who made a purchase from Laguiole Export are covered. Please contact your dealer or the factory directly to handle your products, ensuring they are indeed Laguiole en Aubrac brand products.

(2) As a consumer, you are advised to check the completeness, obvious defects, and transport damages of the item immediately upon delivery and notify us and the carrier of any complaints as soon as possible. If you fail to do so, it doesn’t affect your statutory warranty claims.

a) Only our own information and the product manufacturer’s description are considered the item’s quality, but not other advertisements, public promotions, and statements by the manufacturer or other resellers. Any purchase on this site at a higher or lower rate than another site or store cannot result in a compensation claim against us or a third party.

b) In case of defects, we guarantee, at our discretion, repair or subsequent delivery. If the defect’s removal fails, you can terminate the contract. Defect removal is considered to have failed after a second unsuccessful attempt, unless the nature of the item, the defect, or other circumstances indicate otherwise. For repairs, we do not have to bear the additional costs resulting from shipping the goods to a place other than the place of performance, provided the shipment does not correspond to the intended use of the goods.

c) The lifetime warranty period starts from the delivery of the goods. The warranty does not apply:

For damages culpably attributable to us to life, body, or health and other damages caused intentionally or by gross negligence;
For objects that were used contrary to their intended use and have caused its defectiveness;
For legal claims you have against us in the context of warranty rights.

Article 12. Choice of Law – Dispute Resolution

These distance selling conditions are subject to French law only. For all disputes or litigation, the competent court will be that of Paris, France.

(1) French law applies. For consumers, this choice of law applies only to the extent that it does not remove the protection granted by mandatory provisions of the law of the state in which the consumer has their usual residence (principle of favorability).

(2) The provisions of the United Nations Convention on Sales do not expressly apply.
